The Court heard that in October 2005, Inline Fiberglass Ltd. which manufactures and paints fiberglass materials that it uses to manufacture windows and doors spilled paint wash water wastes, causing a white discoloration to be discharged into Mimico Creek. It was later determined the company had constructed a new paint spray booth in June 2006 which it operated from February to March 2007, without a Certificate of Approval.
Inline Fiberglass Ltd. was charged following an investigation by the Ministry of the Environment's Investigations and Enforcement Branch.
Inline Fiberglass Ltd. pleaded guilty to one count of violating the Ontario Water Resources Act by discharging paint wash water wastes into Mimico Creek, contrary to the Environmental Protection Act, by operating a paint spray booth without a Certificate of Approval and for failing to transfer paint wash water wastes to a transportation system. Inline Fiberglass Ltd. was fined a total of $42,500, plus a victim fine surcharge, and given 20 months to pay.
