Sandwich Store And Director Fined $15,000 Total For Ignoring Order To Pay

Barrie, Ont. - 1144018 Ontario Inc., operating as Subway Sandwiches and Salads, was fined $10,000 on February 9, 2010, for violating the Employment Standards Act (ESA). The company failed to comply with orders to pay wages. Kevin MacGillivray, the company's director, was fined $5,000.
The Ministry of Labour investigated claims for outstanding wages filed by a former employee of the Stayner sandwich shop. An order to pay $1,904.03 was issued to the company but not paid.
The defendants were found guilty of failing to comply with an order issued by an employment standards officer.
The fines were imposed by Justice of the Peace Guy Maurice. In addition to the fine, the court imposed a 25-per-cent victim fine surcharge on the total, as required by the Provincial Offences Act. The surcharge is credited to a special provincial government fund to assist victims of crime.
