Toronto, ON - 1307116 Ontario Limited, operating as All Seasons Windows and Doors, was fined $3,500 for a violation of the Employment Standards Act after failing to comply with an officer's orders. The director of the company, Peter Mitnik, was fined $2,500 in relation to the same incident.
On August 14, 2007, a Ministry of Labour officer issued All Seasons Windows and Doors an order to pay wages that were owing to an employee of the company. The order was never paid or appealed.
1307116 Ontario Limited, operating as All Seasons Windows and Doors, pleaded guilty to failing to comply with orders issued by an employment standards officer. The company was fined $3,500 for the offense and ordered to pay the outstanding wages of $4,268.48.
Peter Mitnik, as director of 1307116 Ontario Limited, pleaded guilty to authorizing or acquiescing in the company's contravention of the Employment Standards Act. He was fined $2,500.
The fines were imposed by Justice of the Peace Kevin Madigan. In addition to the fines, the court imposed a 25-per-cent victim fine surcharge, as required by the Provincial Offences Act. The surcharge is credited to a special provincial government fund to assist victims of crime.
