Ottawa Greenbelt Construction Company Limited fined $125,000 for health and safety violation

OTTAWA, Nov. 26 - Ottawa Greenbelt Construction Company Limited, an Ottawa, Ont.-based water main construction company, was fined $125,000 on November 24, 2003 for a violation of the Occupational Health and Safety Act that resulted in serious leg injuries to an employee. On February 13, 2002, a worker was assisting in an air pressure test for leakage in newly-laid, high-pressure concrete pipes when a joint failed on one of the pipes causing it to be ejected at a high velocity. The "explosion" blew the 2,586-kilogram (5,700-pound) pipe a distance of about 2.1 metres (seven feet) and the worker, who was on top of the pipe, was propelled along with it. One of the worker's legs was severed during the explosion and the other was broken and burnt. A Ministry of Labour investigation found the employer failed to take a number of precautions that could have prevented the accident, including failing to follow hydrostatic testing procedures for a water main. Recognized industry standards prohibit the air testing procedure used in this case. The incident occurred at a City of Ottawa water main installation project west of Albion Road between Leitrim Road and Lester Road alongside a CN rail bed in Ottawa. The City of Ottawa had contracted Ottawa Greenbelt Construction Company Limited to install the water main. Ottawa Greenbelt Construction Company Limited pleaded guilty, as an employer, to failing to take the reasonable precaution of following hydrostatic testing procedures for a water main. This was contrary to Section 25(2)(h) of the act. The fine was imposed by Justice of the Peace Michel Jolicoeur of the Ontario Court of Justice in Ottawa.
