Husky Oil Limited Fined $110,000 For Failing to Comply With Its Certificate Of Approval

WINDSOR, ON, Dec. 19 - Husky Oil Limited has been fined $110,000, plus a victim fine surcharge, after pleading guilty to failing to properly notify the Ministry of the Environment of effluent exceedances and failing to meet its effluent limits. Husky Oil Limited owns a truck stop at 4040 County Road 46 in Tecumseh, Ontario. The truck stop has a sewage treatment facility that operates under an amended Certificate of Approval issued by the Ministry. The Court heard that from September 2005 to January 2006, the company failed to comply with its Certificate of Approval by failing to make oral or written reports on phosphorus exceedances. The court also heard that from October 2005 to December 2005, the company failed to meet its effluent limits set out by the Ministry's amended Certificate of Approval. Husky Oil Limited was charged following an investigation by the Ministry of the Environment's Investigations and Enforcement Branch. Husky Oil Limited pled guilty to one count of failing to comply with its Certificate of Approval by failing to make oral reports of effluent limit exceedances as soon as reasonably possible, contrary to s. 107(3) of the Ontario Water Resources Act. It also pled guilty to one count of failing to make written reports of effluent limit exceedances within seven days of receiving the analytical results of an exceedance. The company also pled guilty to three counts of failing to operate and maintain the sewage works so that the concentration and loading of the effluent parameters prescribed in the Certificate of Approval were not exceeded. The company was fined a total of $110,000 and given 90 days to pay. Justice of the Peace Robert P.
