Court Bulletin - Millard Refrigerated Services-Canada, ULC fined $70,000 for injury of worker

BRAMPTON, ON, Dec. 10 /CNW/ - Millard Refrigerated Services-Canada, ULC pleaded guilty and was fined $70,000 in the Ontario Court of Justice on December 9, 2008, after a worker was injured.
Justice of the Peace M. Eustaquio-Syme heard that on August 23, 2007, at the employer's bulk refrigeration warehouse at 745 Intermodal Drive in Brampton, a temporary help agency employee supplied to Millard Refrigerated Services was driving a "stand up" forklift with inadequate training and collided with a concrete-filled steel post. The worker, who suffered fractures to one leg, required surgery.
Millard Refrigerated Services-Canada, ULC was fined for failing, as an employer, to provide information, instruction and supervision to a worker to protect the health and safety of that worker. This was contrary to section 25(2)(a) of the Occupational Health and Safety Act.
In addition to the fine, the court imposed a 25-per-cent victim fine surcharge on the total, as required by the Provincial Offences Act. The surcharge is credited to a special provincial government fund to assist victims of crime.
