Waste Hauler Fined $8,000 for Environmental Protection Act Violations

Court Location – Brockville
Description of Offence – The convictions relate to operating a waste management system/site not in accordance with an environmental compliance approval, for permitting the discharge of hauled sewage to the ground not in accordance with the environmental compliance approval, and for operating a waste transportation vehicle used for transporting municipal waste without the vehicle being clearly marked with the name and the environmental compliance approval.
Date of Offence – During the period beginning on or about January 21, 2018 and ending on or about November 9, 2018
Date of Conviction – June 24, 2021
Penalty Imposed – The defendants were convicted on three violations under the Environmental Protection Act and were fined a total of $8,000 plus a victim fine surcharge of $2,000 and were given 24 months to pay.
Background –
- The numbered company 2105200 Ontario Ltd. operating as Albert’s Liquid Waste operates from a registered address on Scotch Line Road in Merrickville. Business records indicate that Ryan Miller is the owner and sole Director and Officer of the company.
- On February 10, 2012, the Ministry issued to Albert’s Waste an environmental compliance approval for a waste management system for the management of hauled sewage.
- In January and October of 2018, Mr. Miller conducted land applications of raw liquid sewage waste at/near a site on Davis Road in Merrickville-Wolford, United Counties of Leeds and Grenville, using a waste management vehicle that was part of the waste management system approved by the ministry approval.
- However, the ministry approval that was active on the dates indicated did not permit the company to conduct land applications or otherwise deposit, store or manage sewage waste at the Davis Road site.
- On November 9, 2018, ministry staff conducted an inspection of the company’s waste collection vehicle. During the inspection it was discovered that the waste collection vehicle that was used to transport municipal waste did not display the name and number appearing on company’s environmental compliance approval.
- The ministry’s Environmental Investigations and Enforcement Branch investigated and laid charges which resulted in the convictions.
