Convicted – 2270386 Ontario Inc.

Court Location – Cayuga Court

Description of Offence – The conviction is for failing to comply with a ministry approval by failing to operate a leachate treatment system to not exceed the maximum concentration limit of an effluent parameter, namely total ammonia nitrogen.

Date of Offence – On or about May 6, 2020.

Date of Conviction – January 13, 2023

Penalty Imposed 2270386 Ontario Inc. was convicted of one violation under the Environmental Protection Act and was fined $50,000, plus a victim fine surcharge of $12,500 and given 60 days to pay

Background –

  • 2270386 Ontario Limited owns the Brooks Road Landfill site located on Brooks Road in Cayuga.
  • 2270386 Ontario Limited was issued a ministry approval for an onsite system that collects, treats, and disposes of leachate. This permits the discharge of effluent from the landfill to the natural environment via a roadside ditch located on Brooks Road. The ministry approval includes limits for effluent quality, including total ammonia nitrogen.
  • 2270386 Ontario Limited retained a company to operate the leachate collection system. Licensed wastewater operators collect samples of effluent and are tested at an independent, accredited laboratory.
  • The ministry was notified on May 8, 2020 that the landfill had proactively closed off the discharge of effluent from the system to the roadside ditch. Sampling, not required by the ministry approval, indicated that there may be a concern with ammonia. Effluent was either diverted back to the landfill for further treatment or hauled to the local treatment plant.
  • On May 15, 2020, 2270386 Ontario Limited was informed that the monthly sample taken on May 6, 2020 exceeded the maximum concentration limit specified in their ministry approval for total nitrogen ammonia. The company notified the ministry of the result.
  • The ministry’s Environmental Investigations and Enforcement Branch investigated and laid a charge which resulted in a conviction.
