Waterdown Garden Supplies Ltd. fined $50,000 for violating the Environmental Protection Act and the Ontario Water Resources Act

HAMILTON -- Waterdown Garden Supplies Ltd. has been fined $50,000, plus a victim fine surcharge, after pleading guilty to violations under the Environmental Protection Act and the Ontario Water Resources Act.

Waterdown Garden Supplies Ltd. is in the business of receiving organic waste at its composting facility in Hamilton which operates under the authority of several approvals under the Ontario Water Resources Act and the Environmental Protection Act.  Inspections by the ministry revealed the company was not in compliance with several conditions of its approvals.  Additionally, the company was not properly maintaining its monitoring wells.  A Provincial Officer Order was issued to address the non-compliance issues at the site wells.

Waterdown Garden Supplies Ltd. was charged following an investigation by the Ministry of the Environment's Investigations and Enforcement Branch.  The company pleaded guilty to ten charges, specifically, four counts of failing to comply with a Provincial Officer Order relating to the maintenance of monitoring wells, contrary to a section of the Ontario Water Resources Act, and six counts of failing to comply with the conditions of an approval, contrary to a section of the Environmental Protection Act.  Waterdown Garden Supplies Ltd. was fined $50,000, plus victim fine surcharge, and given 12 months to pay.
