Greg Hart and 836724 Ontario Ltd. fined $33,000 for violating the Environmental Protection Act

HAMILTON -- Greg Hart and 836724 Ontario Ltd. have been fined $33,000, plus a victim fine surcharge, after pleading guilty to violations under the Environmental Protection Act.

The Court heard that Greg Hart and his company, 836724 Ontario Ltd., operate a business specializing in construction and restoration products.  An inspection of the facility by the ministry revealed several instances of non-compliance relating to the storage of waste.  The company did not comply with an order issued to address the problems observed at the site.

Greg Hart and 836724 Ontario Ltd. were charged following an investigation by the Ministry of the Environment's Investigations and Enforcement Branch.

Greg Hart and 836724 Ontario Ltd. pleaded guilty on May 26, 2008 to three violations, including two counts of failing to comply with an order, namely, failing to arrange for the off-site disposal of liquid sludge and failing to ensure that no open drums or containers containing waste or chemicals were left outdoors, contrary to section 186(2) of the Environmental Protection Act, and one count of depositing waste without a Certificate of Approval, contrary to section 40 of the Environmental Protection Act.  Greg Hart was fined $13,500 plus a victim fine surcharge, and 836724 Ontario Ltd. was fined $19,500, plus a victim fine surcharge.  They were given six months to pay.
