Wesley Kuepfer and Nutracomp Industries Inc. fined $22,000 for waste violations

GUELPH -- Wesley Kuepfer has been fined $2,000 plus a victim fine surcharge, and Nutracomp Industries Inc. has been fined $20,000 plus a victim fine surcharge, after pleading guilty to violations under the Environmental Protection Act.

The Court heard that Wesley Kuepfer is the owner of Nutracomp Industries Inc., an agricultural waste product receiver.  Mr. Kuepfer approached a farm owner in Wellington County with an opportunity to take manure, fruit waste, vegetable waste, bakery waste, steel drums of syrup and plastic jugs of other wastes to be composted for raising bait worms.  The farm owner leased a portion of his farm land to Mr. Kuepfer to carry out these operations.  Inspection by the ministry revealed that Mr. Kuepfer and Nutracomp Industries Inc. permitted the deposit of numerous loads of waste at the site, which was not an approved waste disposal site.  Mr. Kuepfer and Nutracomp Industries Inc. also participated in the processing of waste by burning it at the site, which was not approved as a waste management system. 

Mr. Kuepfer and Nutracomp Industries Inc. were charged following an investigation by the Ministry of the Environment's Investigations and Enforcement Branch.

Mr. Kuepfer and Nutracomp Industries Inc. each pleaded guilty on July 2, 2008 to one count of operating a Waste Disposal Site without a Certificate of Approval, contrary to section 40 of the Environmental Protection Act, and one count of operating a Waste Management System without a Certificate of Approval, contrary to section 41 of the Environmental Protection Act.  Mr.  Kuepfer was fined $1,000 per count, totaling $2,000, plus a victim fine surcharge, and Nutracomp Industries Inc. was fined $10,000 per count, totalling $20,000, plus a victim fine surcharge.  The parties were each given one year to pay.
