Lakeside Grain & Feed Limited fined $30,000 for pesticides violations

SARNIA -- Lakeside Grain & Feed Limited has been fined $30,000 plus a victim fine surcharge, after pleading guilty to violations under the Pesticides Act.

The Court heard that Lakeside Grain & Feed Limited is a licensed pesticide vendor in Forest.  An inspection by the ministry identified numerous violations of pesticides storage, display and record keeping obligations.  An inspection report was issued to Lakeside Grain & Feed Limited requiring the company to voluntarily correct the non-compliance.  A further inspection found that not only had the company failed to respond to the action items in the initial report, but several additional violations were also identified.

Lakeside Grain & Feed Limited was charged following an investigation by the Ministry of the Environment's Investigations and Enforcement Branch.

Lakeside Grain & Feed Limited pleaded guilty on June 13, 2008 to one violation of the Pesticides Act, namely offering to sell pesticides that were not classified in accordance with the regulations, contrary to section 6, and nine violations of Ontario Regulation 914 made pursuant to the Pesticides Act as follows: one count of storing pesticides and not being authorized to sell or use those pesticides, contrary to section 24; one count of storing Schedule 5 pesticides in an area not used exclusively for the storage of pesticides, contrary to section 123(1); one count of not displaying Schedule 2 pesticides in such a manner that no person other than the licensee or licensee's employees have ready access to it, contrary to section 125(a); one count of not displaying Schedule 3 pesticides in such a manner that presents a minimal hazard to children, contrary to section 125(b); one count of displaying pesticides adjacent to food intended for animal consumption, contrary to section 125(c); one count of failing to keep a record of each sale of a Schedule 1, 2 or 5 pesticide setting out the name and address of the purchaser, contrary to section 118(1)(a); one count of failing to keep a record of each sale of a Schedule 1, 2 or 5 pesticide setting out the type and class of licence or permit to use held by the purchaser and the licence or permit number, contrary to section 118(1)(b); one count of failing to keep a record of each sale of a Schedule 1, 2 or 5 pesticide setting out a description of the pesticide sold, including the pesticide name, the registration number under the Pest Control Products Act (Canada), the Schedule number, or the unit size and quantity, contrary to section 118(1) (c); and one count of failing to record the number and expiry date of the certified agriculturalist's certificate, contrary to section 118(5)(a).

Lakeside Grain & Feed Limited was fined $30,000 plus a victim fine surcharge, and given 30 days to pay.
