DNX Castonguay Inc. Fined $75,000 For Failing to Report Discharge of Fly Rock

Parry Sound - DNX Castonguay Inc. was fined $75,000 for failing to notify the ministry of a discharge of fly rock that caused damage to nearby properties.

"Charges and convictions remind us all that we need to take care not to damage the environment as we go about our business" said Environmental Minister Jim Bradley.

DNX Castonguay Inc. is a drilling and blasting company with an office in Sudbury, Ontario. a. The company was hired to do blasting at a quarry located on Old Hwy Road West in Magnetawan, Ontario.

On May 12, 2010, flying rock from  blasting at the site caused damage to the roof of a garage on an adjacent property located on Old Hwy Road West..

Fly rock is a contaminant as defined under the Environmental Protection Act. Under the Act, when a discharge of a contaminant  occurs that causes or is likely to cause an adverse effect it is the responsibility of the company to  forthwith notify the ministry of the discharge.  The company failed to provide timely notification.

DNX Castonguay Inc. was fined $75,000 plus a victim fine surcharge of $18,750 and was given 90 days to pay the fine.
