Company Fined $10,000 For Pesticides Act Violations
Hamilton - Brinkman & Associates Reforestation Ltd. was found guilty and fined $10,000 in relation to offences that occurred while the company was applying the herbicide, Garlon XRT to the Borer's Creek floodplain, in violation of the Pesticides Act.
The company specializes in forestry resource management and urban ecosystem restoration. The company was performing land extermination as part of flood planning in the Borer's Creek, near Hamilton.
As a result of a public complaint, the ministry attended the extermination site and noted numerous violations: signage was wrong, pesticides were being applied incorrectly, staff was not wearing the required protective clothing, pesticides had been placed into secondary containers with only cartoon drawings of skull and crossbones, and the company did not possess a valid licence.
The company was convicted of five offences under the Pesticides Act and Ontario Regulation 63/09 and was fined $10,000 plus a victim fine surcharge of $2,500. The company was given 30 days to pay the fine.
