Company Fined $3,500 For Establishing A Sewage Works Without Approval

Newmarket - Spice Environmental Inc. (SEI) pleaded guilty to one offence and was fined $3,500 for establishing a well without an Environmental Compliance Approval (ECA), contrary to the Ontario Water Resources Act.

The company was contacted by Oil Spill Control Services Inc. (OSCS), as they required a qualified individual to support the completion of a Record of Site Condition.

SEI was hired to support the remediation of an old truck wrecking yard located in York Region, as the property was contaminated with oils and other materials from the wrecking process. With input from OSCS, SEI established and wrote a site management plan for the property, which included a stormwater management plan.

SEI directed the excavation of the clean and dirty water trenches as described in the plan, however, this was done without an ECA.

The matter was forwarded to the ministry's Investigations and Enforcement Branch for investigation. Following an investigation, SEI and OSCS were jointly charged with one offence, and OSCS was charged with additional offences.

SEI pleaded guilty to one offence, was fined a total of $3,500 plus a victim fine surcharge of $875, and was given six months to pay the fine.
