Business fined $25,000 for Ontario Water Resources Act Violation

Convicted - Richview Acres Limited

Location - Grand River

Description of Offence -  The conviction relates to the discharge of manure into a ditch which drained into a floodplain.

Date of Offence - on or about May 2, 2016

Date of Conviction - February 2, 2018

Penalty Imposed - On February 2, 2018, Richview Acres Limited was convicted of one offence under the Ontario Water Resources Act (OWRA), was fined $25,000 plus a Victim Fine Surcharge (VFS) of $6,250. The defendant was given one year to pay the fine.

Background -  

  • On April 29, 2016, ministry staff attended Richview Acres for the purpose of conducting a proactive inspection.
  • During the inspection, several potential violations were observed.
  • On May 2, 2016, ministry staff observed a possible manure discharge from an outdoor confinement area, which flowed across the road and through an adjacent field and into a ditch ending up in a flood plain of the Grand River.
  • The matter was referred to the ministry's Investigation and Enforcement Branch, resulting in charges and a conviction.
