Muskoka Cottage Owner fined $30,000 for Discharging Fuel Oil into Water Well

Description of Offence -  The conviction relates to committing the offence of discharging or causing or permitting the discharge of a material, namely fuel oil or other petroleum hydrocarbon, into a water well, which may impair the quality of the water.

Date of Offence - On or about May 16, 2016

Date of Conviction - February 20, 2018

Penalty Imposed - On February 20, 2018, Dieter Hubert Knoppke was convicted of one offence under the Ontario Water Resources Act (OWRA) and was fined $30,000 plus a victim fine surcharge (VFS) of $7,500 with 6 months to pay.

Background - 

  • Dieter Hubert Knoppke owns a cottage property on Bayview Point Rd., in the Lake of Bays, Muskoka.
  • On May 16, 2016, Mr. Knoppke poured heating fuel oil down a well located on a neighbour's property on Bayview Point Rd.
  • The fuel oil which Mr. Knoppke poured down the well is a material that is capable of impairing the quality of the water in the well.
  • The incident was referred to the ministry's Investigations and Enforcement Branch, resulting in charges and one conviction, through a guilty plea.
