Transport Truck Owner fined $1,500 for Drive Clean Violation

Convicted - Michael McCallum

Location - Peterborough

Description of Offence -  The conviction against Mr. McCallum related to operating a vehicle without the contaminant device, contrary to the Drive Clean Program.

Date of Offence - on or about June 4, 2016

Date of Conviction - March 8, 2018

Penalty Imposed - Mike McCallum was convicted of one offence under the Environmental Protection Act (EPA) and was fined $1,500 plus a Victim Fine Surcharge (VFS) of $375 with 6 months to pay. 

Background -  

  • Michael McCallum is a heavy duty (HD) truck owner/operator in the aggregate business, and is the owner of McCallum's Transport Ltd.
  • Between 2015 and 2017, Mr. McCallum owned a 2005 Western-Star truck.
  • On or about May 30, 2016, Mr. McCallum attended an HD mechanical shop and requested an alteration to the truck's emission components. Shortly thereafter, the parts required to conduct the modification were ordered, installed and the truck was operated without the required emissions components, in violation of the Drive Clean Program.
  • The incident was referred to the ministry's Investigations and Enforcement branch, resulting in charges and the conviction through a guilty plea.
