Automobile Owner fined $5,000 for Drive Clean Violation

Convicted - Christopher Ryan Crate

Court Location - Brockville 

Description of Offence -  The conviction relates to the defendant submitting a false address for a licence plate renewal, in order to avoid the statutory requirements of the Drive Clean Program. 

Date of Offence - On or about February 21, 2017

Date of Conviction - October 10, 2018

Penalty Imposed - Christopher Ryan Crate was convicted of one violation under the Environmental Protection Act and was fined $5,000 plus victim surcharge and was given six months to pay the fine. 

Background -   

  • Mr. Crate has been the sole owner of a 2005 GMC Sierra (the subject vehicle) since 2014. 
  • In February 2017, records indicate that Mr. Crate changed his address at a ServiceOntario office from a location in Cardinal to a location in North Bay, and later changed his address back to the original address. As a result of this change, the plate renewal for the subject vehicle was issued, and was exempt from the regulatory emission test due to the address change. 
  • Evidence showed that Mr. Crate never moved to the Northern Ontario address which was outside the Drive Clean Programarea; therefore, the address change submitted to ServiceOntario was entirely false. 

  • The ministry's Investigations and Enforcement Branch investigated and laid one charge resulting in one conviction.
