Vineyard and Winery fined $4,000 for Ontario Water Resources Act Violation

Convicted - Caroline Cellars Ltd.

Description of Offence - The conviction relates to failing to comply with a ministry order to submit a completed amendment application for an industrial sewage approval.

Date of Offence - During the period on or about April 18, 2014 and ending on or about September 14, 2015.

Date of Conviction - September 14, 2018

Penalty Imposed - Caroline Cellars was convicted on one violation under the Ontario Water Resources Act and was fined $4,000 plus a victim fine surcharge of $1,000 and was given six months to pay.

Background -  

  • Caroline Cellars Limited operates a vineyard and winery in Niagara-on-the-Lake.
  • In June 2012, the ministry was in discussions with Caroline Cellars to bring the company into compliance, which required a ministry approval amendment to alter a sewage works system.
  • As of December 2014, the company had not complied and a ministry order was issued. This was also not complied with.
  • The ministry's Investigations and Enforcement Branch investigated and laid charges resulting in the conviction.
