Seniors Residence Facility fined $1,400 for Safe Drinking Water Act Violation

Convicted - Harmony Estate Seniors Residence Inc.

Description of Offence - The conviction relates to failing to ensure that water sampling, collection and analysis requirements were completed in accordance with regulatory requirements.

Date of Offence - during the period beginning on or about December 11, 2017 and ending on or about January 9, 2018.

Date of Conviction - February 6, 2018

Penalty Imposed - Harmony Estate Seniors Residence was convicted on one count under the Safe Drinking Water Act and was fined $1,400 plus a victim fine surcharge of $350 and was given 180 days to pay the fine.

Background -  

  • The company owns and operates a senior assistance residential facility in Courtice, which is supplied drinking water from an on-site drilled well, classified as a Small Non-Municipal Non-Residential system. The facility accommodates up to ten senior residents and up to six staff members.
  • On October 24, 2017, ministry staff conducted an inspection of the company's drinking water system, and identified that the company had failed to sample in accordance with the requirements of the Safe Drinking Water Act and Regulation 170/03.
  • Following the inspection, the company was informed of the non-compliance and was advised of the sampling requirements. The inspector requested that the company provide sample results by January 2, 2018, as confirmation that sampling had been conducted. The company failed to comply.
  • The ministry's Investigations and Enforcement Branch investigated and laid charges resulting in one conviction.
