Lawn Care Company fined $2,400 for Pesticides Act Violation

Convicted - Les Pelouses Nutritek/Lawn Care Ltd.

Description of Offence – The conviction relates to applying a banned Class 9 pesticide for cosmetic purposes.

Date of Offence – On or about August 31, 2017.

Date of Conviction – June 6, 2019

Penalty Imposed – Les Pelouses Nutritek/Lawn Care Ltd. was convicted of one violation under the Pesticides Act and was fined $2,400 plus the victim fine surcharge of $600 and was given three months to pay the fine.

Background:  

  • Les Pelouses Nutritek/Lawn Care Ltd. provides lawn care services in the Rockland area. The company possesses a valid pesticides operator licence and conducts landscape and industrial vegetation exterminations. 
  • On August 31, 2017, the ministry inspected the Nutritek operation and observed a company truck returning from residential weed control applications. A sample of the pesticide product used on those applications was taken from the truck’s weed control/pesticide holding tank.
  • Analysis of the sampled product identified a high concentration of Dicamba, a Class 9 pesticide not approved for cosmetic purposes on residential properties.
  • The ministry’s Investigations and Enforcement Branch investigated and laid charges resulting in one conviction.
