Description of Offence - The conviction relates to providing false or misleading information to ministry staff.

Date of Offence - During the period on or about July 12, 2017 and ending on or about July 12, 2017.

Date of Conviction - November 7, 2019

Penalty Imposed - On November 7, 2019, Kirchmeier Renergy Inc., was convicted on one violation under the Environmental Protection Act and was fined $25,000 plus a victim surcharge of $6,250 and was given six months to pay the fine. 

Background:

  • Kirchmeier Renergy Inc. owns/operates a bio digester in St. Isidore, which generates energy from renewable resources, under a ministry approval. This facility is owned by Thomas Kirchmeier, who is both Director and Officer of the company.
  • In the spring of 2017, the ministry received several odour complaints which resulted in an inspection of the Kirchmeier facility.  During the inspection, the company was asked to submit liquid waste records from 2016 and 2017.  The records were reviewed and were compared with other supplier records, which indicated several discrepancies.
  • An investigation resulted in charges being laid, which resulted in one conviction.
