Expert Review of Ontario's Construction Lien Act

Bruce Reynolds

Bruce Reynolds is a senior partner at Borden Ladner Gervais LLP, the chair of BLG's International Construction Projects Group and an internationally-ranked construction practitioner. Certified by the Law Society of Upper Canada as a Specialist in Construction Law, Mr. Reynolds specializes in the litigation, arbitration and mediation of construction claims, construction liens, surety bond claims, construction insurance claims, product liability, and architects' and engineers' errors and omissions. He also drafts and negotiates contracts for major industrial and infrastructure projects, and construction, engineering, architectural equipment supply, and technology licensing contracts.

Mr. Reynolds acts for a wide variety of clients providing advice in respect of construction projects in Canada, the U.S., and internationally. He was called to the bar in 1983 after earning his LLB at the University of Toronto. Mr. Reynolds has co-authored several definitive construction textbooks that are often cited by courts in Ontario, including: Construction Builders' and Mechanics' Liens in Canada, 7th Edition, Scott and Reynolds on Surety Bonds and A Guide to Canadian Construction Insurance Law (which was co-authored with Sharon Vogel).

Mr. Reynolds was also recognized as the Global Construction Lawyer of the Year in the 2014 edition of Who's Who Legal: The International Who's Who of Construction Lawyers. Also in 2014, he was recognized as the Toronto Construction Law "Lawyer of the Year" by Best Lawyers® in Canada, and was ranked Band 1 for construction law by Chambers Global - The World's Leading Lawyers for Business. As well, he was listed in the 2015 Lexpert/American Lawyer Guide to the Leading 500 Lawyers in Canada, and, in 2014, Lexpert ranked him among both the Leading Litigation Lawyers in Canada and the Leading Infrastructure Lawyers in Canada.

Sharon Vogel

Ms. Vogel is a partner in BLG's Construction Law Group. She practises construction and surety law, working primarily on matters involving construction disputes relating to large-scale infrastructure, industrial and commercial projects including highways, railways, tunnels, pipelines, mines, industrial facilities, hospitals, manufacturing plants, commercial buildings and condominiums in various jurisdictions.

Ms. Vogel specializes in the negotiation, mediation, arbitration and litigation of construction disputes, including construction liens, trust claims, delay claims, surety bond claims, construction insurance claims, and architects' and engineers' errors and omissions claims. She has appeared at all levels of court, including the Ontario Superior Court, Court of Appeal and the Supreme Court of Canada.

Ms. Vogel also has extensive experience drafting construction contracts on behalf of owners, developers, general subcontractors, subcontractors, and suppliers.

She was selected by her peers for inclusion in The Best Lawyers in Canada and the 2014 and 2015 editions of The Best Lawyers in Canada (Construction Law), has a peer review rated 4.6 out of 5 by Martindale-Hubbell® AV® Preeminent™, and is recognized as a leading infrastructure lawyer in the Lexpert Special Edition on Infrastructure.
