Background - Court heard that in the fall of 2015, a conservation officer observed that tree cutting had taken place in the north and west setback areas at a quarry owned by J.C. Rock Ltd. in the City of Kawartha Lakes. Measurements, photos, aerial photography, and GPS data were used to determine the scope of the tree cutting. Approximately 120 metres by 30 metres of trees were unlawfully removed in the north area and approximately 200 metres by 30 metres of trees were unlawfully removed in the west area. The current site plan for this quarry was reviewed by ministry aggregate specialists, who confirmed the cut trees were intended to be left as a natural buffer for quarry operations.
