Two Ontario Men Fined $240,000 for Possession of Unmarked Cigarettes

Description of Offences: Possession of unmarked cigarettes under the Tobacco Tax Act

Date of Offences: April 20, 2016

Date of Conviction: January 26, 2018, at the Kingston Provincial Offences Court

Penalties Imposed: A fine of $120,000 was imposed on Mr. George Maracle.  A $120,000 fine was also imposed on Mr. Victor Maracle. They were each given four months to pay. In addition, the court imposed a 25 per cent victim fine surcharge as required under the Provincial Offences Act.

Background: On April 20, 2016, a vehicle was stopped during an OPP ride program in Sharbot Lake. A subsequent search of the vehicle revealed 1,000,000 unmarked cigarettes. The cigarettes were seized and forfeited.
