Possession of Unmarked Cigarettes Leads to $65,015 Fine

Description of Offences: Possession of unmarked cigarettes for the purpose of sale, under the Tobacco Tax Act

Date of Offences: April 19, 2018

Date of Convictions: June 27, 2019 at the Toronto Provincial Offences Court

Penalties Imposed: A fine of $65,014.70 was imposed on Thanh Luu as well as a two-year probation order. In addition, the court imposed a 25 per cent victim fine surcharge as required under the Provincial Offences Act. A suspended sentence was imposed against Chi Thanh Food Market Inc.

Background: On April 19, 2018, Ministry of Finance inspectors conducted a routine tobacco inspection and seized 116,400 unmarked cigarettes. The tobacco products were forfeited.
